This Privacy Policy explains how Empowering Humans, LLC ("Empowering Humans," "we," "us," or "our") collects, uses, discloses, and protects personal information in connection with our websites, the Empower Suite platform (which powers our Empower Agents offering), the EmpowerTalk.ai voice service, and all related products and services (collectively, the "Services").
We are a Montana-based digital marketing company. This Policy is designed to comply with the Montana Consumer Data Privacy Act (MCDPA), the California Consumer Privacy Act (CCPA/CPRA), the Virginia Consumer Data Protection Act (VCDPA), the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), the Texas Data Privacy and Security Act (TDPSA), the EU/UK General Data Protection Regulation (GDPR), the Telephone Consumer Protection Act (TCPA), and the CAN-SPAM Act.

2. Scope of This Policy
This Policy applies to:
- Our public websites, including empoweringhumansdigitalmedia.com and any subdomains or related marketing sites;
- The Empower Suite platform, including the Empower Agents product used by real estate professionals and other clients;
- The EmpowerTalk.ai voice AI service, including inbound and outbound calls initiated by or on behalf of our clients;
- Client acquisition funnels, CRM automations, forms, chat widgets, SMS, and email campaigns we operate; and
- Any other product, service, or communication that links to this Policy.
3. Information We Collect
3.1 Information You Provide Directly
- Identifiers: name, email, phone number, mailing address, business name, job title.
- Account Information: login credentials, account preferences, billing contact, and information entered into forms, onboarding questionnaires, or intake flows.
- Payment Information: processed securely by our payment processor (Stripe). We do not store full credit card numbers on our servers.
- Communications: content of emails, SMS, chat messages, call transcripts, voicemails, support tickets, and feedback.
- Client Data: if you use Empower Suite, you may upload or input contact lists, lead data, and messaging content ("Client Data"). You are the controller of Client Data; we process it on your behalf as a service provider.
3.2 Information Collected Automatically
- Usage Data: pages visited, time on page, clicks, referring URL, search terms, and platform interactions.
- Device & Technical Data: IP address, browser type, operating system, device identifiers, and general location derived from IP.
- Cookies & Similar Technologies: see Section 8.
3.3 Information From Third Parties
- Advertising Partners: Meta (Facebook/Instagram), Google Ads, and other networks may share campaign attribution, conversion, and audience data.
- Referrals: affiliates, partners, or referral sources who connect leads or clients to us.
- Publicly Available Sources: business listings, professional directories, and public social media profiles used for outreach and lead qualification.
3.4 Sensitive Information
We do not intentionally collect health information, biometric data, Social Security numbers, precise geolocation, government identifiers, or information about minors. If you submit such data, you do so voluntarily. We strongly request that you avoid submitting sensitive information through our forms or platform.
4. How We Use Your Information
We use personal information to:
- Provide, operate, and maintain the Services;
- Process transactions, deliver purchased products, and manage subscriptions;
- Respond to inquiries, provide customer support, and onboard new clients;

9. Targeted Advertising & "Sharing"
We run advertising campaigns on platforms including Meta (Facebook/Instagram) and Google. These platforms may use cookies and pixels we place on our sites to:
- Show you ads for Empowering Humans, Empower Suite, Empower Agents, or EmpowerTalk.ai on other websites and apps (retargeting);
- Measure the performance of our campaigns;
- Build audiences of similar prospects ("lookalike audiences").
Under the MCDPA, CCPA/CPRA, VCDPA, CPA, CTDPA, and TDPSA, this activity may be considered "targeted advertising" or "sharing" of personal information. You have the right to opt out.
To opt out of targeted advertising and "sharing":

- Use the Global Privacy Control (GPC) signal in your browser; we honor GPC as a valid opt-out request where required by law.
- Adjust ad preferences directly with Meta, Google, and other platforms.
10. Calls, Call Recordings, SMS & TCPA Consent
EmpowerTalk.ai and our broader platform may place and receive phone calls and send SMS messages on behalf of our clients and ourselves.
10.1 Call Recording
Calls with Empowering Humans or through our platform may be monitored or recorded for quality assurance, training, dispute resolution, AI model improvement, and service improvement. Where required by applicable law, we will obtain consent or provide notice before recording. Certain states (including California, Florida, Illinois, Massachusetts, Maryland, Montana, New Hampshire, Pennsylvania, and Washington) are "two-party consent" or "all-party consent" jurisdictions; by continuing a call after notice, you consent to recording.
10.2 SMS & TCPA
By providing your phone number and opting in through a form, checkbox, or keyword (such as "START"), you consent to receive calls and SMS messages (including auto-dialed, pre-recorded, or AI-generated messages) from or on behalf of Empowering Humans, LLC at the number provided, including for marketing purposes. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies.
To opt out of SMS: reply STOP to any message. For help, reply HELP or email [email protected].
10.3 Client Use of EmpowerTalk.ai
When our clients use EmpowerTalk.ai to contact their own leads and customers, those clients are the senders of record and are responsible for obtaining all required consents and complying with the TCPA, state telemarketing laws, and the Do Not Call (DNC) registry. We provide tools to support compliance but do not guarantee the legality of any specific campaign configured by a client.
11. Email Communications & CAN-SPAM
Our marketing emails include clear identification of the sender, a physical mailing address, and a one-click unsubscribe link. We honor unsubscribe requests promptly and in accordance with the CAN-SPAM Act. You may also request removal by emailing [email protected].
12. Data Retention
We retain personal information for as long as necessary to provide the Services, fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Typical retention periods include:
- Active account data: for the duration of the account plus up to seven (7) years after termination for tax, accounting, and legal purposes.
- Call recordings and transcripts: up to twenty-four (24) months unless a longer period is required for legal or dispute resolution purposes.
- Marketing contact data for non-clients: until you opt out or request deletion.
- Backup and log data: up to ninety (90) days in routine backup rotations.
Upon account termination, clients generally have thirty (30) days to export their data before deletion, unless otherwise agreed in a written service agreement.
13. Data Security
We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit, access controls, vendor diligence, and secure payment processing through PCI-DSS-compliant providers. No system is 100% secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
14. Your Privacy Rights
Depending on where you live, you may have some or all of the following rights:
- Access / Know: request a copy of the personal information we hold about you.
- Correct: ask us to correct inaccurate information.
- Delete: request deletion of personal information, subject to exceptions.
- Portability: receive your information in a portable, machine-readable format.
- Opt Out: opt out of targeted advertising, "sales" or "sharing," and certain profiling.
- Withdraw Consent: where we rely on consent, withdraw it at any time.
- Non-Discrimination: we will not discriminate against you for exercising any of these rights.
- Appeal: appeal a denial of your request (where applicable state law requires).

15. State-Specific Rights (US)
Montana Residents (MCDPA)
If you are a Montana resident, you have the right to confirm whether we process your personal data, access it, correct inaccuracies, delete it, obtain a portable copy, and opt out of targeted advertising, sale of personal data, and certain profiling. California Residents (CCPA/CPRA)
California residents have rights to know, delete, correct, opt out of "sale" or "sharing," limit use of sensitive personal information, and non-discrimination. Our disclosures of categories of personal information collected, sources, purposes, and recipients are described in Sections 3, 4, 6, and 7. You may designate an authorized agent to submit requests on your behalf.
Virginia, Colorado, Connecticut & Texas Residents
Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), and Texas (TDPSA) have rights substantially similar to Montana residents, including access, correction, deletion, portability, and opt-out of targeted advertising, sale, and profiling. We honor GPC signals where applicable.
Other States
If your state has adopted a comprehensive consumer privacy law, we will honor the rights afforded to you under that law. Contact us to exercise your rights.
16. EU/UK Rights (GDPR)
If you are located in the EU, UK, or EEA, in addition to the rights above you have the right to lodge a complaint with your local data protection authority. You may also object to processing based on legitimate interests and request restriction of processing. Empowering Humans does not currently have an EU-based establishment; if we rely on an EU representative in the future, contact details will be listed here.
17. Children's Privacy
Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA). If you believe a child has provided us with personal information, contact us immediately and we will delete it.
18. Health Information & HIPAA
Empower Suite and EmpowerTalk.ai are not HIPAA-compliant by default. We do not intend to collect, process, or store Protected Health Information (PHI) as defined under HIPAA. Clients in healthcare or related industries must not upload or transmit PHI through the Services unless a signed Business Associate Agreement (BAA) is in place with Empowering Humans, LLC. If you upload PHI without a BAA, you do so at your own risk and in violation of our Terms of Service.
19. International Data Transfers
We are based in the United States and process personal information in the U.S. If you access our Services from outside the U.S., your information will be transferred to and processed in the U.S. Where required, we rely on Standard Contractual Clauses (SCCs) or other lawful transfer mechanisms for international transfers.
20. Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other reasons. We will update the "Last Updated" date at the top of this page. For material changes, we will provide additional notice such as an email or prominent notice on our website.
21. Governing Law & Venue
This Policy is governed by the laws of the State of Montana, without regard to its conflict of law principles. Empowering Humans, LLC maintains a principal place of business in Livingston, Park County, Montana, and a satellite office in Yellowstone County, Montana. Any dispute arising out of or relating to this Policy or the Services shall be brought exclusively in the state or federal courts located in Yellowstone County, Montana, and you consent to the jurisdiction and venue of those courts.
